Two Departments Release the "Catalog of Goods Subject to Export Licensing (2026)"

In accordance with the Foreign Trade Law of the People's Republic of China, the Regulations of the People's Republic of China on the Administration of Import and Export of Goods, the Regulations on the Administration of Ozone-Depleting Substances, the Measures for the Administration of Goods Export Licenses, the Measures for the Administration of Import and Export of Ozone-Depleting Substances, and other relevant laws, administrative regulations, and regulations, the "Catalog of Goods Subject to Export License Administration (2026)" (hereinafter referred to as the Catalog) and related matters are hereby announced as follows:

I. Application for Licenses
(1) In 2026, a total of 43 types of goods are subject to export license administration. For details, please refer to the Catalog. Foreign trade operators exporting goods listed in the Catalog must apply to the Ministry of Commerce or local commercial authorities entrusted by the Ministry of Commerce for the "Export License of the People's Republic of China" (hereinafter referred to as the Export License). The Export License must be presented to customs for clearance procedures.

(2) For the export of live cattle (to Hong Kong and Macao), live pigs (to Hong Kong and Macao), live chickens (to Hong Kong), wheat, corn, rice, wheat flour, corn flour, rice flour, artificially cultivated ephedra for medicinal use, coal, crude oil, refined oil (excluding lubricants, greases, and lubricant base oils), sawn timber, and cotton, the Export License must be applied for based on quota certification documents. For the export of licorice and licorice products, as well as rush and rush products, the Export License must be applied for based on quota bidding winning certification documents.

(3) For the export of goods listed in Item (2) under processing trade, the Export License must be applied for based on quota certification documents and the goods export contract. Among these, for the export of licorice and licorice products, as well as rush and rush products, the Export License must be applied for based on quota bidding winning certification documents and the customs import declaration form for processing trade.

(4) For the export of goods listed in Item (2) under border small-scale trade, local commercial authorities at the provincial level shall issue the Export License in accordance with the border small-scale trade quotas and requirements issued by the Ministry of Commerce. For the export of licorice and licorice products, rush and rush products, ozone-depleting substances, motorcycles (including all-terrain vehicles) and their engines and frames, automobiles (including complete knock-down kits) and their chassis, etc., under border small-scale trade, an Export License must be applied for in accordance with regulations. For the export of goods other than those mentioned above under border small-scale trade, no Export License is required.

(5) For the export of live cattle (to markets other than Hong Kong and Macao), live pigs (to markets other than Hong Kong and Macao), live chickens (to markets other than Hong Kong), beef, pork, chicken meat, natural sand (including standard sand), bauxite, phosphate ore, magnesite, talc blocks (powder), fluorite (fluorspar), rare earths, tin and tin products, tungsten and tungsten products, molybdenum and molybdenum products, antimony and antimony products, coke, refined oil (lubricants, greases, lubricant base oils), paraffin wax, certain metals and their products, sodium sulfate, silicon carbide, ozone-depleting substances, citric acid, silver, platinum (exported under processing trade), indium and indium products, motorcycles (including all-terrain vehicles) and their engines and frames, automobiles (including complete knock-down kits) and their chassis, an Export License must be applied for in accordance with regulations. Among these, samples, advertising materials, donations, returns, and residual liquids of ozone-depleting substances require an Export License for export. For the export of automobiles and motorcycles under general trade, processing trade, border trade, and donation trade, an Export License must be applied for under specified conditions. For the export of automobiles and motorcycles under project contracting, an Export License must be applied for based on materials such as the filing receipt for overseas contracted projects or the approval receipt for specific projects. For the export of non-China-origin automobiles (limited to new vehicles) and motorcycles under the aforementioned trade methods, an Export License must be applied for based on import customs documents and the goods export contract.

(6) For the export of goods listed in Item (5) under processing trade, unless otherwise specified, the Export License must be applied for based on relevant approval documents, the customs import declaration form for processing trade, and the goods export contract.

(7) In accordance with the Export Control Law of the People's Republic of China and the Regulations of the People's Republic of China on the Export Control of Dual-Use Items, if the goods in this Catalog fall under the dual-use items listed in the dual-use item export control list or are subject to temporary control, export operators must apply for and obtain the "Export License for Dual-Use Items and Technologies of the People's Republic of China" in accordance with laws and regulations. Among these, if an Export License has been obtained but the Export License for Dual-Use Items and Technologies has not yet been obtained, the Export License for Dual-Use Items and Technologies must still be obtained upon exit. If the Export License for Dual-Use Items and Technologies has been obtained, no Export License is required.

(8) Goods provided under the foreign aid programs of the Chinese government are exempt from applying for an Export License.

(9) The state trading management for the export of lubricants (Customs Commodity Code 27101991), greases (Customs Commodity Code 27101992), and lubricant base oils (Customs Commodity Code 27101993) under general trade continues to be suspended. For the export of the aforementioned goods under general trade, the Export License must be applied for based on a valid goods export contract. For the export of the aforementioned goods under other trade methods, the provisions of Announcement No. 30 of 2008 by the Ministry of Commerce, the National Development and Reform Commission, and the General Administration of Customs shall apply.

II. "Non-Batch-Specific" and "Batch-Specific" Systems
(1) The following goods are subject to the "non-batch-specific" system: wheat, corn, rice, wheat flour, corn flour, rice flour, live cattle, live pigs, live chickens, beef, pork, chicken meat, crude oil, refined oil, coal, motorcycles (including all-terrain vehicles) and their engines and frames, automobiles (including complete knock-down kits) and their chassis (limited to new vehicles), goods exported under processing trade, and goods exported under compensation trade. For the export of the aforementioned goods, the Export License can be used multiple times for customs clearance within its validity period, but the number of uses must not exceed 12 times.

(2) The export of ozone-depleting substances, used automobiles, and natural sand (including standard sand) is subject to the "batch-specific" system. The Export License can be used for one customs declaration within its validity period.

III. Designated Ports for Goods Clearance
The designated port management for the export of goods such as magnesite, rare earths, and antimony and antimony products continues to be suspended.

IV. Export Licensing Authorities
The Ministry of Commerce and local commercial authorities at the provincial level entrusted by the Ministry of Commerce, as well as the commercial authorities of Shenyang, Changchun, Harbin, Nanjing, Wuhan, Guangzhou, Chengdu, and Xi'an, shall accept applications from applicants and implement export licensing in accordance with their respective divisions, issuing Export Licenses to eligible applicants.

The term "local commercial authorities at the provincial level" in this announcement refers to the commercial authorities of provinces, autonomous regions, municipalities directly under the central government, cities with independent planning status, and the Xinjiang Production and Construction Corps.

V. Implementation Time
This announcement shall take effect from January 1, 2026. Announcement No. 65 of 2024 by the Ministry of Commerce and the General Administration of Customs is hereby repealed.
